Is there anyone that can advise please on this issue,
8 years ago we bought a building plot joining "green belt" land. This land was formerly part of a farm and the land that is now our garden was mainly a farm track of brick and clay. After building our home we purchased a small plot of land at the rear of our plot which again was green belt/ agricultural land. After digging out all the bricks and clay from the farm track we imported a large amount of top soil so that we were able to grow plants and vegatables as nothing would grow on the original plot. (we do have an areial photo of the plot after we built the property showing the original farm track).
8 years on, we now have a productive veg plot and fruit garden and a small amount ( 4 metres in depth by 15 mtrs in lenght) of land that we have developed into formal garden, i.e lawn and plants to join onto our "lawful formal garden area". i.e plants and lawn. However, the local council have decided that they are going to define the current green belt area in our local authority area and our garden falls within that scheme. Our Council are not sure exactly where the boundary is and I am not sure how they will determine it. The impact upon us is that some of our garden that falls within what the council term the greenbelt area is veg plot and about 4 mtrs is formal garden.
My questions are as follows.
1) What is the difference between green belt and agricultural land and how do I definitivly determine what our land is?
2) If the council determine that we have encroached upon the green belt/agricultural land what can we do with green belt land to stay within the law?
3) What can we do to appeal any adverse decision as all the other properties on our road have the same boundry line as we do if not even further beyond our boundry line, some with established buildings but were build some 20 years or more ago and we are informed that they are discounted from any decision because of there age?
4) What sanctions would the council have upon us to return our land to green belt and would we have to return it to clay and brick as it was where nothing would grow?
Any help will be apprecited.
